Terms of service
The agreement between us and whoever books an event. Written plainly, because terms nobody reads protect nobody.
Last updated
These terms are between you and Coderize, which operates TakeUrOwn. By booking an event or using the service you agree to them. If you are agreeing on behalf of a company or organisation, you are confirming you are allowed to.
What the service is
Guests at your event scan a QR code, upload photos and short clips from their phones, and those appear on a slideshow and in a shared gallery. You can moderate what is shown and download every original afterwards.
Your account
- You are responsible for what happens under your account and for keeping your password to yourself.
- Moderator credentials let whoever holds them hide and delete photos at your event. Give them to the person working the room, not to everyone — and issue a new one from your dashboard if one goes astray.
- Tell us promptly if you think someone else has got into your account.
What you are responsible for
This is the part that matters most, because your guests are the ones being photographed.
- Telling people it is happening. You are responsible for making attendees aware that photos taken at your event may be uploaded and displayed on a screen. A line on the invitation or a card on the table is usually enough.
- Having the right to use the photos. You confirm you have whatever permissions your event requires — from attendees, from a venue, from an employer — to collect and display photos of the people there.
- Face search, if you switch it on. This processes biometric information about your guests. Some places regulate that specifically and some require written consent before it happens. Before you enable it, make sure that is handled for your event and your attendees. It is off unless you turn it on.
- Moderating your own event. We give you the tools to pull anything off every screen in seconds, and to require approval before anything appears at all. Deciding what belongs on your screen is your call, not ours.
Who owns the photos
Your guests own what they shoot, and you own your event. We do not. You give us only the permission we need to run the service: to store the files, show them on your event's screens and gallery, and let you download them.
We do not sell, license, publish, or train anything on your photos. We will not use them to market this product. If we ever want to show one in a case study, we will ask you first and take no for an answer.
What is not allowed
Do not use the service to collect or display:
- Anything unlawful, or anything that harasses, threatens, or defames someone.
- Sexual content, or any image of a child that is sexual in nature.
- Photographs taken where people have a reasonable expectation of privacy.
- Material that infringes someone else's copyright.
We can remove content and close an event that breaks this. We would rather email you first, and normally will, but for something serious we will act immediately.
Paying
- Per-event plans are paid before the event opens to guests. Invoiced events are due on the terms on the invoice.
- The agency plan bills monthly and renews until cancelled. Cancel any time from the billing portal; you keep access to the end of the period you have paid for. We do not pro-rate part months.
- Prices can change, but never for a plan you have already paid for.
Refunds
If the service fails on the day through our fault, tell us and we will refund the event. If your event is cancelled or moved before it starts, tell us and we will move the booking or refund it. We do not refund an event that ran as it should have because fewer guests uploaded than you hoped.
What we promise, and what we do not
We work hard to keep this running, particularly on the day of an event. We do not offer a guaranteed uptime figure, and we would rather say so than print a number we cannot stand behind. The service depends on things outside our control — your venue's connectivity above all. A dead room means a slideshow that cannot receive photos, and no software fixes that.
Photos are backed up and retained for the period on your plan, but the download of your originals is yours to take. Take it. Do not treat this as your only copy of anything you cannot lose.
If something goes wrong
Nothing here limits liability for anything the law does not allow us to limit — including fraud, or death or personal injury caused by negligence. Beyond that, our total liability to you for any claim is limited to what you paid us for the event or, for the agency plan, in the twelve months before the claim.
We are not liable for lost profits, lost business, or indirect losses. The service is provided as it is; we do not make warranties beyond what is written here.
Ending it
You can stop using the service at any time and ask us to delete your data. We can suspend or end an account that breaks these terms, does not pay, or is being used to harm someone. If we end your account without cause, we will refund anything you have paid for events that have not happened.
The rest
- These terms are governed by the laws of the State of Michigan, United States.
- If we change them, we will update the date at the top and email account holders about anything significant. Continuing to use the service after that means you accept the change.
- If any part of this is unenforceable, the rest still stands.
- Questions go to hello@takeurown.com and are answered by a person.
